Website Terms, Production Licence Terms & Privacy Policy
1. Definitions
In these Terms, unless the context otherwise requires:
- “Bilby”, “we”, “us” or “our” means Bilby Theatrical Productions Pty Ltd (ABN 15 082 925 219) of PO Box 4798, North Rocks NSW 2151, Australia.
- “You” or “School” means the school, educational institution, or individual purchasing or using a Licence or accessing the Website.
- “Website” means bilbyproductions.com and any associated subdomains.
- “Licensed Materials” means the scripts, musical scores and backing tracks, Director’s Vision Guide, choreography videos, and any other production resources made available to you under a Licence.
- “Licence” means the right granted to a School under clause 4 to use the Licensed Materials to stage a Production.
- “Production” means a single season of staged performances of a specific show by a specific School.
2. Website Terms of Use
This section governs your use of the Website generally, separate from any Licence you hold (see clause 4).
2.1 Intellectual Property
All content on the Website—including text, images, video, audio, scripts, scores and choreography material—is protected by copyright under Australian law. Except as expressly permitted under a Licence or these Terms, you must not copy, reproduce, republish, distribute, transmit, broadcast, sell, or otherwise exploit any content from the Website without our prior written consent.
You may view and browse the Website for personal, non-commercial reference. Provided you keep all content unaltered, you may temporarily cache pages via your browser in the ordinary course of browsing.
2.2 Accuracy and Changes
We aim to keep Website content accurate and current, but we may change or correct it, including pricing and availability, at any time without notice. You are responsible for checking these Terms periodically. Continued use of the Website after changes are posted constitutes acceptance of those changes.
2.3 Third-Party Links
The Website may link to third-party websites. We are not responsible for, and do not endorse, the content or privacy practices of any linked site.
2.4 Liability
To the maximum extent permitted by law, we exclude all liability (whether in contract, tort, including negligence, or otherwise) for the accuracy, suitability or completeness of Website content.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded.
Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupply of the relevant goods or services or the cost of resupply.
2.5 Governing Law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
If any provision is found invalid or unenforceable, the remainder continues in full force.

3. Privacy Policy
Bilby Theatrical Productions Pty Ltd is committed to protecting your privacy and handles personal information in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth).
3.1 Information We Collect
We may collect personal information such as your name, role (e.g. teacher, administrator), school name, email address, phone number and payment details when you:
- Enquire about or purchase a Licence.
- Create an account to access Licensed Materials.
- Subscribe to our newsletter.
- Contact us with a query.
As with most websites, we and our service providers may automatically collect technical information such as browsing activity, IP address, and cookies, used for site administration, security and improvement.
3.2 Use and Disclosure
We use personal information to provide Licensed Materials and support, process payments, respond to enquiries, and (with consent) send newsletters or updates.
We may disclose information to service providers who help us operate the Website (e.g. payment processors and hosting providers), or where required by law.
We do not sell personal information to third parties.
3.3 Children’s Information
Our Website and Licences are intended for use by teachers, school staff and administrators acting on behalf of a School, not by children directly.
We do not knowingly collect personal information directly from children under 18 through the Website.
Any images or footage of student performers are addressed separately in our Image and Video Consent clause (5.3).
3.4 Security and Access
We take reasonable steps to protect personal information from misuse, loss and unauthorised access, whether held electronically or in hard copy.
No transmission over the internet can be guaranteed to be completely secure.

4. Production Licence Terms
4.1 Grant of Licence
On payment of the applicable fee, Bilby grants the School a non-exclusive, non-transferable licence to use the Licensed Materials solely to rehearse and stage one Production of the specified show, at the School named on the order, for the performance dates or season specified.
4.2 Licensed Materials and Access
- Scripts and music/backing tracks are provided as downloadable files upon payment for the school’s retained use for that Production.
- The Director’s Vision Guide is provided as a downloadable PDF.
- Choreography videos are provided via streaming access through the Website for a period of 12 months from the Licence start date, after which access expires unless renewed.
- Login credentials are for use by authorised staff of the school only and must not be shared outside the school.
4.3 Permitted Use
- Reproduce scripts and sheet music in the quantity reasonably required for the cast, crew and musicians involved in the Production.
- Rehearse and stage the Production as a non-commercial school performance (see clause 4.5 on ticketing).
- Use the Director’s Vision Guide and choreography videos to inform staging, direction and choreography of that Production only.
4.4 Restrictions
Unless we agree otherwise in writing, the School must not:
- Sub-licence, sell, lend or share the Licensed Materials with any other school, group or third party.
- Video or audio record any performance or rehearsal for distribution, broadcast or online publication (including social media) beyond a private archival copy for the school’s own records.
- Livestream any performance without our prior written consent.
- Alter, adapt or abridge the script or music in a way that changes the substance of the work without our written consent.
- Use the Licensed Materials for a further Production (e.g. restaging in a later year) without obtaining a new or renewed Licence.
4.5 Ticketing
Schools may charge admission to cover reasonable production costs (venue, costumes, printing) without requiring a separate commercial performance licence, provided the Production remains a non-ticketed-for-profit school event.
If you intend to run performances beyond your own school community (e.g. open to the public at a commercial venue), contact us first, as a different licence tier may apply.
4.6 Renewal / Restaging
A School wishing to restage a previously licensed show in a later year must obtain a renewed Licence. We offer renewal at a reduced fee compared to a first-time Licence, reflecting that materials have previously been supplied.
4.7 Fees and Payment
All fees are quoted in Australian dollars and, unless stated otherwise, are inclusive of GST.
Full payment is required before Licensed Materials are released.
We accept payment via [EFT / Card / Invoice — confirm your methods].
4.8 Cancellation, Postponement and Refunds
Because scripts, tracks and guides are supplied digitally, once any Licensed Materials have been downloaded or streaming access has been activated, the Licence fee is non-refundable, except where required under the Australian Consumer Law (for example, if the Licensed Materials are materially not fit for purpose).
If a School’s Production is postponed or cancelled due to circumstances beyond its control (e.g. extended school closures or natural disaster), we will work with the School in good faith on options such as extending streaming access or applying the fee toward a future Production, at our discretion.
4.9 Intellectual Property in Licensed Materials
All copyright and other intellectual property in the Licensed Materials remains the property of Bilby Theatrical Productions Pty Ltd (or its licensors) at all times.
The Licence grants a right of use only and does not transfer any ownership or intellectual property rights.
5. General Trading Terms
5.1 Pricing and Orders
We may correct pricing errors or update Website information at any time.
We will notify you by email of any pricing discrepancy identified after your order before proceeding.
5.2 Digital Delivery
As Licensed Materials are supplied digitally, there is no physical shipping.
Access is typically provided within [1–2 business days] of payment being confirmed, via email and/or your Website account.
5.3 Image and Video Consent
Where we collect photographs or video of student performers for marketing or promotional use (e.g. show photos or trailers), we will only do so with the express consent of the School and in accordance with the School’s own child-safety and parental consent procedures.
Schools should ensure appropriate parental or guardian consent is obtained before any student imagery is shared with us.
5.4 Child Safety
Bilby Theatrical Productions is committed to the safety and wellbeing of all children involved in Productions using our Licensed Materials.
While we do not directly supervise school rehearsals or performances, we expect all Schools to maintain their own child-safe policies and supervision consistent with relevant state or territory child protection legislation.
5.5 Accessibility
We aim to make the Website and our resources accessible to users of varying abilities and will address accessibility feedback raised via info@bilbyproductions.com.
